What is my tax rate?
The amount of your Cannabis Activity Tax depends on the kinds of activity you are engaged in. If you are a
cultivator, then the amount of your tax is a function of the square footage of the cultivation area you have
registered or that you applied for. If you provide medical cannabis through a dispensary then you pay a tax
based on a percentage of the gross proceeds from your sales. The framework for determining your cannabis
business activity tax is provided in Calaveras County Code §§ 3.56.030(B)(1)-(3).
The tax rate for commercial cannabis cultivation is:
1) For Outdoor and Mixed Light Licensees or Registrants: $2.00 per square foot of registered or
permitted canopy area. This shall be how your tax rate is calculated until the Department of Food and
Agriculture has established and implemented a track and trace program under Business and
Professions Code 19335 et seq. After that, the rate will be $45.00 per pound of dry weight flower and
bud and $10.00 per pound of dry weight trim; and
2) For Indoor Licensees or Registrants: $5.00 per square foot of registered or permitted canopy area
commencing upon adoption of the voters until the Department of Food and Agriculture has
established and implemented a track and trace program under Business and Professions Code 19335
et seq; and thereafter $70.00 per pound of dry weight flower and bud and $15.00 per pound of dry
weight trim; and
3) A gross proceeds tax of seven percent (7%) on the manufacturing of cultivated cannabis; and a gross
proceeds tax of seven percent (7%) on retail medicinal collectives or dispensaries for general
For example, if you are growing 2,000 square feet of marijuana at an outdoor or mixed light cultivation site,
your total tax bill will be four thousand dollars ($4,000). If you have a 2,000 square foot indoor cultivation
site, then your total tax bill will be ten thousand dollars ($10,000).
